Terms and Conditions
General
These terms apply to all sales by Heywood Holt Bowden & Co to the exclusion of any other terms unless otherwise agreed in writing. Heywood Holt Bowden & Co reserves the right to make changes to the items shown on this website and to remove selected styles. We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery.
Delivery
Stock items will normally be despatched within 2 working days from receipt of order. At our discretion we may deliver the goods in reasonable instalments. Each instalment is to be treated as a separate contract and you must accept and pay for instalments accordingly. Any claim for non-delivery of or damage to the goods in transit should be made within 7 days of the invoice for them. Our liability in respect of any such claim notified to us within 7 days is limited to the replacement of the goods or refund of the price, at our discretion, and does not extend to any indirect or consequential loss.

Price
The price of the goods will be the price ruling at the date of despatch. All prices quoted exclude post & packing and VAT. All applicable post & packing and VAT is payable by you in addition to the contract price. Orders up to a value of £500 plus VAT will incur a post & packing cost charge of £5.95 plus VAT for deliveries within the UK. You must pay our reasonable extra charges in respect of any special arrangements made at your request or any costs, expenses and liabilities we may incur because you have given inadequate or inaccurate instructions.
Payment
If you have a credit account we will invoice you for the goods with any applicable delivery charge and VAT at the time of despatch of goods to you or your designated recipient. Invoices must be paid in full within 30 days. We will exercise our statutory right to claim interest and compensation for the debt recovery costs under the late payment of commercial debts(interest)act 1998(as amended) if you do not pay amounts due to us by the due date.
Risk & Ownership
The risk in goods passes to you when the goods are delivered to the delivery address. Ownership of the goods remains with Heywood Holt Bowden & Co until payment has been made in full.
If a) you make any voluntary arrangement with your creditors or become bankrupt or become subject to an administration order, or go into liquidation: or b) you cease to, or threaten to cease to carry on business: or c) Heywood Holt Bowden & Co reasonably believes that any of the above events are about to occur and notifies you accordingly: then you shall cease at once to use any goods not then paid for and shall on demand return any of them remaining in your possession. On making such a demand, we are entitled, without incurring any liability to you, to enter your premises and remove and repossess such of our goods as are to be found there and also to cancel any contract with you.
Force Majeure
Where we are unable to perform due to any circumstances beyond our control we may suspend performance while those circumstances subsist and any agreed date or period for delivery shall be regarded as extended accordingly. If any period of suspension of deliveries lasts for more than 3 months, either party may cancel any contract accordingly.
Returns Policy
If any garments are not required we will replace them or refund their value provided that they are returned to us carriage paid within 30 days of delivery. Garments must be unused (except for the purposes of trying on), in their original packaging and otherwise fit to be returned to stock.
A written note must be enclosed quoting the invoice number and stating the reason for the garments return.
All returns will incur a £2.00 per garment reprocessing charge.
In the case of return of 10 or more garments, a handling charge relating to the administration costs incurred may be applied by Heywood Holt Bowden & co.
Refunds will not be made for garments altered in anyway.
Goods returned are done so at your risk and you are advised to use a service which provides a guarantee of delivery.
Limitation on Liabilty
Heywood Holt Bowden & Co shall not be liable: a) in respect of any defect arising otherwise from fair wear and tear, or arising from wilful damage, negligence, failure to follow care instructions, abnormal working conditions, misuse or alteration: b) if the total price for the goods has not been paid by the due date.
Where goods are faulty, at our discretion, will either refund the price of the faulty goods or replace them. Heywood Holt Bowden & Co shall not be liable whether direct or consequential or otherwise but in any event Heywood Holt Bowden & co's liability shall be limited to the price of the goods.
Damage to your Computer
Heywood Holt & Bowden makes every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it won't cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website and screen out anything that may damage it. Heywood Holt & Bowden shall not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

This contract shall be governed by the laws of England and both parties shall submit to the non-exclusive jurisdiction of the English court.
